Do the #BasicLaw and the Sino-British Joint Declaration contain any provision at all on the implementation of “dual universal suffrage”?
Under the Basic Law and the Sino-British Joint Declaration, the HKSAR shall be a local administrative region of the PRC, which shall enjoy a “high degree of autonomy” and come directly under the Central People’s Government.
Under the Basic Law, the method of selecting the CE and forming of the Legislative Council shall be specified in the light of the actual situation of the HKSAR and in accordance with the principle of gradual and orderly progress. Selecting the CE and electing all members of the Legislative Council by “universal suffrage” is enshrined as an “ultimate” aim, but there is no specified timeframe to achieve this. Besides, the Sino-British Joint Declaration does not have any provision at all concerning “dual universal suffrage”. In addition, under the Basic Law, if there is a need to amend the method for selecting the CE, such amendments must be made with the endorsement of a two-thirds majority of all the members of the Legislative Council and the consent of the CE, and they shall be reported to the Standing Committee of the National People’s Congress for approval.
