A female suspect can only be arrested by a female police officer?
We notice that there is some misunderstanding about the law concerning arrest by police officers.
One of the common questions was: if a person to be arrested is a female, can the person insist that the arrest should only be made by a female police officer?
The answer is: NO! There is no law that says that only police officers of the same sex can declare arrest on the arrested persons.
However, with regard to body search, under Chapter 44-05 of the Police General Orders, a person can be searched only by a police officer of the same sex. If there is no female police officer on the spot to search a female suspect, that woman should be brought to the nearest police station so that the search can be carried out by a female officer.
